NEW YORK CITY COMMERCIAL WASTE ZONING
The NYC Council passed Local Law 199 which redefines how commercial waste and recycling is collected across our 5 boroughs. In accordance with the DSNY's Commercial Waste Zones implementation, ALL businesses will be required to take action.
What is the Commercial Waste Zones (CWZ) Program?
New York City has adopted a zoning model for commercial waste and recycling collection that divides the City into 20 distinct Commercial Waste Zones (CWZs). The NYC Department of Sanitation (DSNY) will authorize only three (3) carting companies to service customers in each zone and only five (5) carting companies to service dumpsters & compactors citywide. By law, ALL businesses are required to enter a written service agreement with an authorized carting company from their respective zone.
What does it mean for your business?
All NYC businesses will be required to enter a written service agreement with an authorized hauler during the zone-launch period prescribed by the DSNY. Any existing service agreement (whether written or verbal) governed under the Business Integrity Commission (BIC), will no longer be in compliance on the first day that your zone is “live.” All service agreements must be converted to the new DSNY-approved service agreement to remain compliant. Only DSNY service agreements will be valid once a zone has officially activated.
What happens if a business doesn’t want to enter a new contract?
If any business does not enter a written service agreement with an authorized hauler during the zone-launch period, the DSNY will assign one of the three awarded haulers to that business and enter them into a service agreement at the maximum permissible service rates. To avoid DSNY’s hauler assignment at max rates, you are encouraged enter into a service agreement with an authorized hauler of your choice.
When does my business have to take action?
DSNY determines timelines for zone "transition periods". Between the start of your zone's transition and the official "go-live" date, you will need to enter a CWZ service agreement. As timelines are announced, all zone transition periods can be found at actioncarting.com.
